Abolish the New Pension Scheme from Indian Railway: Railway Minister's DO letter to Finance Minister

Dear Shri P. Chidambaram ji,

Through this letter, I wish to draw your attention to a long standing demand raised by both Staff Federations of Railways on National Pension Scheme (NPS) for employees of Indian Railways. The Federations have been expressing resentment over operation in the Railways of the National Pension Scheme, which is perceived as a lower social security cover for Railway employees. Their contention is that there are enough grounds for Railway employees to be treated differently from other civil employees of the Government, and that Indian Railways should operate the traditional defined .benefit pension scheme available to pre-01-01-2004 appointee's.


You will recall that a few organizations/categories of Government employees were specifically exempted from the purview of NPS on consideration of special, riskier and more onerous nature of duties. The Federations have been drawing parallel with of nature of duties performed by most categories of Railway employees with those in the Armed Forces. They contend that during British period, Railways was conceived and operated as an auxiliary wing of the Army. It was also realized that by virtue of its complex nature, Railways required a high level of discipline and efficiency to be able to perform its role as the prime transport mode. Railways is an operational organization required to be run round the clock through the year. Railway employees have to work in inhospitable conditions, braving extreme weather, unfriendly law and order scenario, and inherent risks associated with the Railway operations itself. As in the Armed Forces, many have to stay away from their families for long periods while performing duties in areas where adequate facilities are lacking.

I feel that there is considerable merit in the contention of the Staff Federations. Besides the critical and complex nature of duties of Railway employees, the hazards involved are also high. Despite best efforts for enhanced safety measures, a large number of Railway employees lose their lives or meet with serious injuries in the course of performance of their duties each year.

During the period 2007-08 to October 2011, the number of Railway employees killed during the course of their duty has been more than number of passengers/other members of public killed in Rail related accidents including accidents at unmanned level crossings. While the nature of duties of Railway employees is inherently high risk during peace time, they also perform functions of critical importance during war time and times of natural calamities, in moving men and materials across the country to maintain supply of essential commodities and safeguard integrity of the nation.

In my view, there are adequate grounds for the Government to consider exemption for Railway employees from the purview of NPS. The implications of this would be that Government expenditure would reduce over the next few years through discontinuance of Government Contribution under the NPS, but the long term liabilities would increase, as financial commitments in the defined benefit pension scheme would be higher. Since Railways are required to meet the pensionary outgo from their internal resources, switch over to defined benefit pension scheme would call for a more systematic provisioning under the Pension Fund through appropriate revenue generating measures. With Rail Tariff Authority on the horizon, I believe that this would be possible.

In the light of the above, I suggest that our request for exemption from operation of the NPS be considered sympathetically and necessary approvals communicated.

The Supreme Court today held that a woman employee of central government can get uninterrupted leave for two years for child care, which also includes needs like examination and sickness.

A bench of justices S J Mukhopadhaya and V Gopala Gowda set aside the order of Calcutta High Court which had held that Central Civil Services (Leave) Rules do not permit uninterrupted CCL(Child Care Leave) for 730 days.


"On perusal of circulars and Rule 43-C, it is apparent that a woman government employee having minor children below 18 years can avail CCL for maximum period of 730 days i.e. during the entire service period for taking care of upto two children. The care of children is not for rearing the smaller child but also to look after any of their needs like examination, sickness etc," the bench said.


It said that CCL even beyond 730 days can be granted by combining other leave if due and the finding of the High Court was based neither on Rule 43-C nor on guidelines issued by the central government.


The court passed the order on a petition filed by a woman government employee Kakali Ghosh challenging government's decision not to grant her leave of 730 days for preparing her son for secondary/senior examinations.



She had first approached Central Administrative Tribunal Calcutta for getting leave. The tribunal had ordered in her favour but the High Court reversed the order after which she moved the apex court.


The apex court set aside the High Court's order.


"We set aside the impugned judgement dated September 18, 2012 passed by the Division Bench of Calcutta High Court, Circuit Bench at Port Blair and affirm the judgement and order dated April 30, 2012 passed by the Tribunal with a direction to the respondents to comply with the directions issued by the Tribunal within three months from the date of receipt/ production of this judgement," it said.

1. Revision of HSG I Recruitment Rules -- On the Way:
 It is informed that the Revised HSG-I Recruitment Rules has been approved by the DoPT. Now the clearance of Law Ministry is pending. As per the DoPT instructions, minimum 5 years service is required for promotion from HSG II to HSG I. All Circle Secretaries /Divisional Secretaries are instructed to take immediate action to fill up all the HSG I vacancies as per the existing HSG I Recruitment Rules if not already done especially before notification of revised rules.
               2.  Cadre Restructuring Committee— Present Stage:
The DDG(P) & Chairman, Cadre Restructuring Committee intimated that the current Proposal (Click to see)  submitted by the Staff side is to be put for discussion under internal meeting of the official side (Govt.side). Thereafter formal Cadre Restructuring Committee Meeting with the Staff side (Union side) will be convened shortly to finalize our current proposal.

Dear Comrades,
                  
As already mentioned in the last month’s “General Secretary’s Desk” a Special Convention and Workshop of all Circle Secretaries and Divisional/Branch Secretaries of AIPEU Group-C will be held on 2014 May 26th & 27th (Monday, Tuesday) at Shah Auditorium, New Delhi,exclusively to discuss the P-3 specific issues and for preperation of the draft memorandum of AIPEU Group-C (CHQ) to be submitted to the 7th Central Pay Commission.  The draft memorandum prepared in the workshop will be placed in the website and also before the Central Working Committee of AIPEU Group-C (CHQ) to be held in August 2014 in Andhra Pradesh Circle, for final approval.

All Circle/Divisional Secretaries of AIPEU Group-C are requested to attend the convention and Workshop WITHOUT FAIL.  If any Circle/Divisional/Branch Secretary cannot attend due to unavoidable circumstances, one representative should be deputed on behalf of Divisional / Branch/ Circle Union.  Limited number of special visitors will also be allowed to attend.  Please book your tickets well in advance.  Please convene your Divisional/Branch/Circle Working Committees/Circle Councils before coming to Delhi and discuss and finalise all P-3 specific points to be included in the 7th CPC Memorandum in a most democratic and transparent manner.  Suggestions should be the outcome of collective discussion and collective wisdom. Active involvement of rank and file members may also be ensured in the process.

DELEGATE FEE:

As CHQ is holding the Special Convention and Workshop at New Delhi itself it is decided to fix delegate fee of Rs.700/- (Rs. Seven hundred only) per head.  Food (only lunch and Tea) and accommodation (hall with floor beddings and bath room facilities) will be provided by CHQ.  Delegate fee is reduced from Rs.1,000/- to Rs.700/- as the Breakfast and Dinner is not arranged by CHQ.  Convention will be from 11 AM to 7 PM on both days.  The rent of the AC Auditorium for two days itself comes to Rs. One Lakh Twenty Thousand (Rs.1,20,000).  AC is required as May is the hottest season in Delhi.  Draft memorandum prepared by CHQ will be supplied in the convention/workshop along with file.

Total Expenditure may come to Rs. 4,50,000/- (Rs. Four Lakh Fifty Thousand only) NO DELEGATE WILL BE ALLOWED TO PARTICIPATE IN THE CONVENTION/WORKSHOP WITHOUT PAYING DELEGATE FEE. THIS WILL BE STRICTLY IMPLEMENTED.

IMPORTANT

All CHQ Office Bearers and Circle Secretaries who are attending the 4th April 2014 Nagpur Confederation National Convention and also the 26th & 27th May, 2014 Delhi Convention and Workshop on 7th CPC P-3 specific Memorandum are requested to bear their TA/DA from their respective Circle Unions.  As the CWC is to be held in the month of August 2014 in Andhra Pradesh Circle and again in November 2014 at Jamnagar (Gujarat) in connection with the final ceremony of NFPE Diamond Jubilee Celebrations,  we have to pay the TA/DA to all office bearers and Circle Secretaries (CWC members) attending the CWC.  Paying TA/DA for Nagpur and Delhi conventions also will result in huge expenditure for the CHQ. All CHQ office bearers and Circle Secretaries are requested to co-operate and bear with the CHQ.

CIRCLE/DIVISIONAL/BRANCH SECRETARIES - YOUR ATTENTION PLEASE:

As we have to devote full two days for discussion and preparation of P-3 memorandum to be submitted to 7th CPC, we will not be getting any time to discuss the pending problems of Circle/Divisional/Branch Unions.  Hence there will not be any discussion on Circle/Divisional/Branch level pending issues in the Special Convention & Workshop.  However the CHQ want to consolidate all pending problems of Circles/Divisions (other than Pay Commission related issues) and the General Secretary will explain the position of each case in the Special Convention/Workshop.

In order to facilitate the CHQ to consolidate and reply the position / action taken in respect of all the important pending issues in the Convention/Workshop, all Circle/Divisional/Branch Secretaries are requested to fill up the enclosed Proforma-I and send it to the CHQ on or before 30th April, 2014.  Please ensure that the report is sent before the cut-off date without fail, ie. before 30-04-2014.  Please fill up Proforma-II also and send it before 30-4-2014, so that CHQ can provide accommodation only for those delegates who actually want it.  It is presumed that many delegates may hire hotel accommodation at their own cost.

ENROL NEW MEMBERS IN THE MONTH OF APRIL, 2014.

In some circles, in each Division, there are employees who are not yet enrolled as members in any union (Non-members).  Similarly some employees from other unions may be willing to join our Union.  Further many new-recruits who joined the department are yet to be enrolled as members under check-off system (Recovery of subscription from pay-roll). All the above categories of employees are to be enrolled in the membership of AIPEU Group-C in the month of April.  All Divisional/Branch Secretaries and Circle Secretaries are requested to make a special drive to collect the declaration from all non-members in April, 2014.  Declaration should be submitted in the same proforma submitted at the time of membership verification.  Signature of Director (SR) not required.  No other change.  Modified order of Directorate already cancelled and old order stands.  White paper application not enough.  It should be in the proforma itself.  Please note.

Dear Sir,

Sub: -  Terms of Reference of the 7th Central Pay Commission.

We have gone through the Terms of Reference of 7th Central Pay Commission approved and notified by the Government on 28.02.2014. We find that the Terms of Reference finalized by the Government is at variance in many respects to the Draft Terms of Reference the Staff Side had submitted to you on 25.10.2013 after holding in-house discussion on 24.10.2013.

At the conclusion of the meeting held on 24.10.2013, it was agreed that the Government would consider our suggestions in the matter and will convene another meeting with the presence of the Secretary (Expenditure) to iron out the differences, if any, and explore the possibilities of an agreement in the matter.

We regret to inform you that no such meeting was convened and no attempt was made by the Official Side to arrive at an agreed Terms of Reference. We find that the Government has rejected the suggestions of Staff Side for either taking a decision in the matter of Interim Relief, Merger of DA, representation of labour nominee in the Commission itself, inclusion of the Grameen Dak Sewaks within the purview of the 7th CPC, bringing parity in pension between the past and present pensioners, covering the employees appointed on or after 01.01.2004 within the ambit of the Defined Benefit Pension Scheme, date of effect, settlement of the pending items in the National Anomaly Committee etc. or referring those issues to the Commission itself for an Interim Report.

Besides, we are to state that the existing Productivity Linked Bonus (PLB) Scheme, being a bilateral agreement, cannot be subjected to scrutiny and examination by the 7th CPC.

We, therefore request you to kindly convene a meeting of the Standing Committee of National Council (JCM) to discuss the issue, so as to make amendments to the Terms of Reference finalized by the Government arbitrarily.
